Odd developments of the Pollachi sexual assault case!

The lapse and failure of Tamil Nadu state police in filing proper evidences against the accused of the Pollachi sexual assault case had eased the possibilities for the detainees to get bailed out from the captivity as by citing the inability of the police, the Madras High court had today dismissed the charges of Goondas act that were booked against two suspects which had granted them the prospects to table bail petition towards acquiring the bail.

Thirunavukkarasu and Sabarirajan have been named as the two among four prime suspects in molesting and sexually assaulting a Pollachi based woman in February this year after which the state police had registered the accused under Goondas act, which carries the provision of imprisoning the person for a year without the possibilies of getting bail but however, the Madras High court had today observed that the police department failed to disclose the proper documentations and justifications on booking the accused under the charges of Goondas further to which the state's top judicial body had directed to drop off the charges through which the accused had awarded with the relaxations and to appeal bail from the judiciary.

The High court had issued its directives after hearing the petition that was tabled by the parents of accused Thirunavukkarasu and Sabarirajan where in their petition, they had cited that the police had failed to disclose proper details to the respective families about levying Goondas act on the two suspects. While hearing the petition, the high court bench comprised of Justices Sundresh and Teekaa Raman had noted that the families and relatives of the accused hadn't given with sufficient and relevant documents as the pretext for booking under Goondas act. The Justices had further stated that the charges imposed on the suspects under Goondas act were unclear and dismissed the charges that was passed by District collector.

In March 2019, one month after the accused were detained, the district collector of Coimbatore had consented the order to impose Goondas act against four men and further to the order from the collector, the accused were booked under the Goondas act - that would award imprisonment for the accused for one year with no grounds for bail but eventually, the inability of police department to disclose the clear and proper papers could now open the gates for the accused as they would likely seek bail from the court within one year.

Thirunavukkarasu, Sabarirajan, Sathish and Vasanthakumar are the four men who sexually assaulted a woman in her car during a friendly meeting on February 12th, 2019 and after detaining the accused, the police sources had stated with conformity that they had taken a video using which they allegedly cheated the victim. After the woman had registered a complaint with police, three of the accused Sabarirajan, Vasanthakumar and Sathish were arrested on February 24th while the other accused Thirunavukkarasu was handcuffed on March 5th, 2019. The case was later probed by the CBI, which filed a charge sheet on the case in the month of May.
