The resignation of the Chief Justice of Madras High court Tahilramani had been accepted by President Ram Nath Kovind and she has been replaced by the senior most Justice of the High court Vineet Kothari who will be the acting Chief Justice for one of the oldest and prestigious courts in India until further orders have been issued.
The decision from the head of the state had come days after since Tahilramani had tabled her resignation from one of the top judicial posts in the wake to oppose the recommendation of Supreme collegium to transfer her from Madras High court to relatively smaller high court of Meghalaya, the north eastern court which chairs only three justices.
The Madras High court has been droned under judicial controversies since the last week of August, when the Supreme court collegium headed by the Chief Justice of India had proposed the recommendations to transfer Tahilramani to Meghalaya high court. It has been reported that Justice Tahilramani will be replaced by the Meghalaya High court Justice Ajay Kumar Mittal for which the collegium had cited that the move has been taken in order to have better judicial administration. After being issued with transfer to the court which was constituted on 2013, Justice Tahilramani had pleaded the collegium with her reconsideration request to call off her transfer but the collegium had eventually stood with its recommendations and rejected her plea of retaining the highest office in Madras High court.
In the wake of odd developments, Justice Tahilramani had sent her resignation to the President and to the Chief Justice of India in the first week of September after which the bar council and advocates union of Tamil Nadu and Puducherry had collectively sent solidarity to Justice Tahilramani where the advocates had reportedly boycotted the court proceedings to stage protest against the decision of collegium and they had urged the five members collegium to take back the decision that had oiled the unrest in the premises of Madras High court which was already been packed with pending cases.
While the Supreme court collegium had stayed with its recommendations, the President had yesterday approved her resignation in what it had appeared that the collegium seemed to be dumb on the request of Justice Tahilramani. The order by the President further stated that she will be replaced by Justice Vineet Kothari as acting Chief Justice of Madras High court which the fourth largest court in India.
Justice Tahilramani had took the office of Chief Justice of Madras High court on August 12, 2018 before which she served as the acting Chief Justice of Bombay High court. By accepting her resignation, the week long muddle in the high court has been brought to an end.
