In the middle of having been anticipated that former Indian finance minister P Chidambaram will be sent to Tihar prison, Asia's largest detention facility, the Supreme court had today, while hearing his anticipatory bail, ruled out that Chidambaram won't be sent to Tihar but instead, the court had extended his custodial interrogation under CBI.
While hearing his bail plea today which he filed to skip the arrest of the CBI with the connection to the illegal clearance given to INX Media group to acquire exorbitant overseas funds, the counsel of P Chidambaram headed by the senior lawyer and Congress leader Kabil Sibal had argued that his party colleague is going to observe his 74th birthday later this month and stated that there must be some protection to Chidambaram due to his age factor further appealed to the apex court asking to keep him under house arrest instead of lodging in Tihar jail.
The top court had directed the legal team of P Chidambaram to file the regular bail plea in the trail court which Kabil Sibal had blamed the move of humiliating people. After expressing his rebuttal to the directive, he stated that the top court can't humiliate the people as the legal team of former minister seemed to be appearing with the possibilities of sending him to judicial custody if the trail court had rejected his bail plea. After requesting to keep him under house arrest, the supreme court bench had questioned the counsel of Chidambaram on the reason for skipping to place the request before CBI special court, which hears the matters and accusations that were filed by CBI.
Echoing the statements of the Justices, the CBI had said that the decision on whether the Congress leader will be held or freed is vested with the CBI, which is investigating the allegations that were made against him on giving illegal clearance. After hearing the arguments, the top court had finally ordered with granting the CBI with extended period of custodial interrogation till Thursday by shutting down the doors of Tihar, which had speculated to welcome Chidambaram. It further added that Chidambaram has an option of filing petition for interim bail in CBI special court and he will remain in the custody of CBI, even his request for interim bail got rejected by the trail court.
Chidambaram has been under CBI custody since August 21st, 2019 with the possible connection of giving illegal clearance to the INX Media group to acquire huge foreign fund which was exorbitant than permitted by the Foreign Investment Promotion Board (FIPB) through the mediation of his son Karti Chidambaram, when he was the then Union Finance minister in 2007.
Later in 2017, CBI had registered his name along with his son's while in 2018, Enforcement directorate had lodged its complaints in 2018 under the grounds of money laundering.
