The Madras High court had issued notice to the Election commission with accordance to the petition filed in its bench which had questioned the victories of the leaders of DMK allied parties who have contested in the Lok Sabha elections 2019 under DMK's tag in what it has appeared with possibilities that their victories have been doubted by the judiciary.
Petitioner Ravi, through his petition, had stated that the DMK party had swept massive victory in 2019 general elections through forming strong alliance where some of the leaders of the allied parties like Ganesamoorthy of MDMK party, Ravikumar of Viduthalai Siruthai Katchi, Chinraj of Kongunadu Makkal Desiya Katchi and Paarivendar of Indiya Jananayaga Katchi have sworn in as the member of Lok Sabha after acquiring victory by contesting under DMK's tag.
He further cited that the legislation of Election commission debars the person to contest in elections under one party's tag where he doesn't hold a membership in the party and it also directs that the leader of one particular party would be barricaded to contest the elections from the other recognized party and demanded the high court to pronounce their victories as null and void under the grounds of violating the norms of the election commission.
This petition was tabled in the bench comprising Justices Sathyanarayana and Seshasayee where the justices questioned the election commission on the possibilities of the candidates to contest in election from a political party where they don't hold any membership and added that the procedure of contesting in an election is more important than the victory in the election.
While rebutting the plea, the advocate who represented the election commission had stated the importance of understanding the grounds on which the returning officer had accepted such nominations and indicated that this petition don't levy on the hands of getting filed as a public interest litigation and urged the high court bench to reject the plea.
After hearing the arguments from both sides of the aisle, the high court bench had issued notice to the election commission, the DMK party and its allied parties to revert its responses within November 12th, 2019.
